TERMS OF SALE
Our primary mission is to help our customers
achieve their home furnishing dreams. We do this by offering a wide selection of
brands and styles at our famous low prices. Coupled with these tremendous
savings is our deep commitment to meet or exceed our customers' expectations.
The following Terms of Sale explain our policies and procedures as they relate
to your potential order.
Article
I - Terms of Payment:
TD’s requires a minimum one-third deposit on
special orders by cash, check or credit card. Remaining balances are due by
check within 15 days of furniture arriving from the factory. The following
special items must be paid in full at the time you place your order: items that
are shipped directly from the factory to the customer; items that are purchased
from our showroom; and custom orders. Special order prices are subject to change
should the manufacturer retroactively increase or decrease prices after the
order has been placed.

II - Special Orders:
Special orders from the factory take
approximately 8-12 weeks to ship to our warehouse. Delivery to your home then
takes an additional 3-4 weeks. We are not able to accept returns on special
order items, nor are we able to accept cancellations once the factory enters the
order into production.

III - Deliveries:
You will receive your delivery
approximately 3-4 weeks after you remit payment for your final balance.
Deliveries to the West of the Mississippi generally take 4-6 weeks. We will hold
your furniture past 30 days for a fee of 1% of the total purchase price per
month.

IV - Warranties:
TD’s Furniture takes pride in the
products and services it offers. We carefully advise you of the manufacturer's
reputation, quality, and design, but the actual choice and selection is the
customer's responsibility. Although we cannot guarantee the customer's pleasure
in his or her selection, we warrant that all merchandise will be delivered in a
condition that meets standards set by the manufacturer. Due to the substantial
discounts offered by TD’s, minor door and drawer alignments as well as minor
touch-ups are the customer's responsibility. If you consider an item defective,
our customer service department will request pictures on behalf of the factory
to substantiate the defect. TD’s reserves the right to deluxe or repair
defective pieces. Only the manufacturer can decide to replace a defective piece.
Manufacturers do not guarantee fabrics against wear or color-fastness, nor do
manufacturers typically assume responsibility for defects past one year from the
manufacturers' invoice date. All showroom samples are sold in "As-Is"
Condition. It is the customer's responsibility to assume the cost of returning
defective pieces that were originally picked-up by the customer from our
warehouse and/or showroom locations.
Article V -
Damage:
Please inspect each piece when it is
delivered and note any problems on the bill of lading. In the event of damage or
defect, the delivery company may be able to solve the problem in your home.
Otherwise, you must note the problem on the bill in order to initiate a claim
against the shipping company. TD’s will assist you in the claims process,
although this assistance does not imply that we will assume responsibility for
damages that occurred during shipment. No matter what the problem, TD’s will
do whatever possible to repair or replace defective or damaged merchandise.

VI - Sales and Use Tax:
TD’s Fine Furniture is not responsible
for collecting or submitting sale or use taxes for any state other than Alabama.
TD’s collects sales tax on all items delivered in Alabama or picked up in
Alabama. Other states may be subject to a "use" tax on the use of
property within a particular jurisdiction. Our customers are encouraged to
consult their state and local tax laws in order to determine the amount of their
use tax liability, if any.
DELIVERY
INFORMATION
There are several different ways you can
receive your furniture from us. Each option is explained in detail below. Please
note that shipping charges are paid directly to the delivery company at the time
of delivery by certified check, cash, or money order. Shipping charges are
calculated by weight and distance, and your sales consultant will estimate these
charges before you place your order.
CUSTOMER PICK-UP
You can arrange to pick-up your furniture
at our warehouse. Please note that Alabama law requires that we collect sales
tax for all furniture that you pick-up from one of our warehouse facilities. We
also ask that you give us a 24-hour notice before picking-up your furniture so
that we can prepare your furniture for shipment. Inspect your Furniture before
it is loaded, You will be asked to sign our pick up ticket stating your
furniture was in satisfactory condition before you left TD's. Also that it is
tied and secured to your satisfaction. This protects our customers insuring them
there Furniture is in good condition at time of Pick Up, and protects TD's from
damage claims caused by mishandling the furniture once it has left our property.
If it looks like rain please bring a tarp to cover your furniture. TD's
employees will load and tie (secure) your furniture to your satisfaction. If you
have rope or pull ties please bring them with you. If not we will supply the
material for securing you Furniture.
SELECT YOUR OWN DELIVERY COMPANY
We can arrange for your furniture to be
picked-up at our warehouse by a carrier of your choice. If you decide to choose
a carrier we do not normally use, we simply ask that you sign a waiver releasing
us from further liability in connection with your furniture delivery. The
manufacturer's warranty remains in effect.
SELECT A TD’s FURNITURE APPROVED CARRIER
TD’s Fine Furniture can arrange to deliver
and set-up your furniture through one of our approved delivery companies. We
deal with a limited number of delivery companies who we have found provide
reliable service and above-average problem resolution skills. We have a close
working relationship with these companies, and these partnerships mean that your
deliveries are handled with the utmost care and professionalism.
Delivery Method
All Deliverys will be made by a shipper chosen by TD's Fine Furniture. If the
customer specifies a delivery company, we will attempt to use that company. If
for reasons of size, weight, timing, or any other reason determined by our
shipping department, the package may and or will be shipped with a shipping
company of the shipping department choosing. Delivery will be by the shippers
normal delivery method. UPS for example will deliver to your door, if no one is
home, and the shipper has a policy not to leave packages without a signature,
you can reschedule but UPS and many other shippers will not set up an exact time
to meet you at your door. Many oversize items (too large for UPS) will be sent
via delivery truck that will only get the item to the 'sidewalk'. You will need
to carry the item into your home. This is common in New York City and other
areas with 'High Rise' buildings. The delivery companies will only give a time
period which sometimes can be an entire day. You will have to make arrangements
to receive the package or have someone at your home or business to receive the
package. Please note that UPS and many other delivery companies charge a
surcharge for Saturday deliveries and if you would like to arrange a Saturday
delivery, please email for additional pricing. If a recipient is notified of a
delivery date, and the recipient is not there to meet the shipper and accept the
package, the recipient will be responsible for any and all 'redelivery' charges
that may apply.

Here
is a step-by-step explanation of the delivery process:
1. Before you place
order, please make sure that the furniture you are purchasing will fit through
your house and can be placed in the area of your choosing.
2. In the case of
special orders from the factory, please remember that the manufacturer must ship
the furniture to our warehouse before we can release your furniture for delivery
to your home.
3. After we receive
your furniture, we will contact you to make arrangements for final payment.
Final payments to TD’s Fine Furniture are due by check within 15 days after we
receive your furniture.
4. After the balance
has been satisfied, we will contact a carrier to pick-up the furniture from our
warehouse. The delivery company will then take your furniture to their warehouse
and submit your order to their routing department for scheduling. You will
receive your delivery within 3-4 weeks after the carrier picks up your furniture
from our warehouse. Deliveries West of the Mississippi generally take 4-6 weeks.
5. The delivery
company will contact you within 2-3 weeks after receiving your furniture to
set-up a delivery time. PLEASE REMEMBER THAT YOUR FURNITURE WILL BE DELIVERED
ALONG WITH MANY OTHER CUSTOMERS' ORDERS AND THAT YOUR
FLEXIBILITY IN ARRANGING A CONVENIENT TIME IS MOST APPRECIATED.
6. The delivery company
will give you a 4-hour window on the day that they intend to make your delivery.
7. In preparing for
your furniture to arrive, please clear all pathways leading to the area in
which you would like the delivery personnel to set-up your furniture.
8. The delivery
personnel will set-up the furniture in your house. PLEASE NOTE THAT NO
ADDITIONAL TIME IS ALLOCATED FOR THE DRIVERS TO MOVE OTHER FURNITURE IN YOUR HOUSE.
Requests to move furniture in your home not associated with your furniture
delivery from TD’s Fine Furniture will not be honored.
9. Once the delivery is
complete, the drivers will place all cardboard and trash associated with
your delivery in a spot that you designate. Federal regulations prohibit the
delivery company from hauling trash and discarded cardboard. The drivers can cut
the cardboard into smaller pieces upon your request.
10. Most deliveries
occur without any problems. However, should your furniture become damaged during
transit, please note any problems on the delivery company's Bill of Lading. We
recommend that you follow-up with the delivery company Claims Department within
3-5 days of receiving your furniture. Most delivery damages are minor and can be
resolved by a trained restoration specialist. PLEASE NOTE THAT THE DELIVERY
COMPANY RESERVES THE RIGHT TO REPAIR ANY FURNITURE DAMAGED DURING TRANSIT. Your
satisfaction is our number one goal, so please remember that we will work
with you to resolve any problems that may arise as a result of your
delivery.
These guidelines are meant to inform you of
exactly how the delivery process works. Should you have additional questions,

TD’s
sells furniture. Life presents problems and furniture is no different. Should
you receive a shipment that does not meet your expectations, TD’s Furniture is
pledged to provide the highest level of service possible.
Furniture repair. In most cases, the
manufacturer, item number and nature of the problem are all that is required to
remedy most furniture situations. Please note some problems may require
photographs of either the damage or defect. TD’s Furniture will work as
quickly as possible to ensure your complete satisfaction.
Once we receive your description, you will be assigned a customer service
representative. This person will work with either the transportation or
manufacturer to determine the nature of the problem and the best solution.
